Terms and Conditions of Sale
1. General Terms
1.1. These Terms and Conditions of Sale ("Terms") apply to all sales of products and goods ("Products") by Monster Parties Trade Limited ("the Company") to customers within the United Kingdom.
1.2. By placing an order for Products with the Company, the customer acknowledges that they have read, understood, and agreed to these Terms.
2. Order Placement and Acceptance
2.1. All orders are subject to acceptance by the Company. An order confirmation email will be sent to the customer upon acceptance of their order.
2.2. The Company reserves the right to refuse or cancel any order for any reason, including but not limited to product availability, pricing errors, or suspected fraudulent activities.
3. Product Descriptions and Pricing
3.1. The Company makes every effort to provide accurate and detailed descriptions of its Products. However, variations in colour, size, or design may occur due to monitor settings or other factors. The customer should read the product description carefully before placing an order.
3.2. Prices of Products are displayed in British Pounds (GBP) and are exclusive of applicable taxes, unless otherwise stated. The Company reserves the right to adjust prices at any time without prior notice.
4.1. Payment for Products must be made in full at the time of order placement. The Company accepts payment by credit/debit cards, bank transfers, or any other payment method specified on the website.
4.2. In the event of payment failure or non-payment, the Company may cancel the order or suspend delivery until payment is received.
5.1. The Company will make every effort to deliver the Products within the specified timeframe. However, delivery times are estimates and are not guaranteed. The Company will not be liable for any delays caused by circumstances beyond its control.
5.2. The customer is responsible for providing accurate and complete delivery information. Any additional costs incurred due to incorrect or incomplete information will be the responsibility of the customer.
6. Right of Cancellation
6.1a. Under the Distance Selling Regulations, the customer has the right to cancel the order and return the Products within 14 days of receipt, without providing a reason.
6.2a. To exercise the right of cancellation, the customer must notify the Company in writing or through the provided cancellation form within the 14-day period.
6.3a. If the customer cancels the order before the Products are dispatched, a full refund will be issued, including any delivery charges.
6.4a. If the Products have been dispatched, the customer must return them to the Company at their own expense. The Products must be returned in their original condition and packaging.
6.1b You will only be able to cancel or amend any personalised product order within an hour of placing that order. After this time it is likely that your ordered may well have been processed and therefore it will not be possible to cancel or amend it.
6.2b We are however keen to give our customers every opportunity possible to amend or cancel their order so we would urge you to contact us as soon as possible and we will help where we can.
6.3b During our normal working hours (9:00am to 4:30pm) please ring us directly on 01268 906 760. Outside of these hours please email us on email@example.com.
6.4b Unfortunately once your order has been processed it is not possible to cancel or amend it unless it is faulty
6.5b Monster Parties Trade Limited produces personalised products to order. Please allow 2-3 days for products to be completed before despatch occurs. Once completed your goods will be despatched using the method chosen by you on your order.
6.6b The Company cannot take any responsibility for the quality of any image or any typographical mistakes made by you. Whilst we do our best to check the quality of what has been provided we cannot take responsibility for it. It is your responsibility to ensure that you have permission to use the images that you provide us. We reserve the right to refuse any order if we feel that it may infringe any copyrights. We therefore may ask you to provide evidence that you have permission before we will process your order.
6.7b We also reserve the right to refuse any order if the material provided would infringe common decency or breach any laws on discrimination.
7. Returns and Refunds
7.1. In addition to the right of cancellation, the customer has the right to return faulty or damaged Products within 30 days of receipt. The Company will arrange for a replacement or issue a refund, as deemed appropriate.
7.2. For non-faulty non-personalised Products returned within 30 days of receipt, the customer will be refunded the purchase price of the Products, excluding any delivery charges. The customer is responsible for the cost of return shipping.
8. Limitation of Liability
8.1. The Company's liability for any direct or indirect loss or damage arising from the sale or use of its Products is limited to the purchase price of the Products in question.
8.2. The Company will not be liable for any loss of profits, business interruption, or any other consequential or indirect damages.
9. Intellectual Property
9.1. All intellectual property rights related to the Products, including trademarks, logos, and designs, are owned by the Company. Customers may not use, reproduce, or distribute any such intellectual property without prior written consent from the Company.
10. Governing Law and Jurisdiction
10.1. These Terms and all sales of Products are governed by the laws of England and Wales.
10.2. Any disputes arising from these Terms or the sale of Products shall be subject to the exclusive jurisdiction of the courts of England and Wales.
11.1. The Company reserves the right to amend these Terms at any time. Any changes will be effective immediately upon publication on the Company's website.
